What is the difference between Joint Petition and Unilateral Divorce (Single Petition)?

Joint Petition means both husband and wife agree to divorce and agree on all terms (children, maintenance, property, etc.).

Unilateral Divorce (Single Petition) means only one party wants the divorce. The other party does not agree or does not respond.

Generally, the minimum period of marriage is 2 years before you can file for divorce.

Yes but only under Annulment.

Annulment may be allowed if:

• The marriage was never consummated because one party could not or refused to do so;
• One party did not properly agree to the marriage (forced, mistaken, mentally unsound, etc.);
• One party had a serious mental disorder at the time of marriage;
• One party had a communicable sexually transmitted disease at the time of marriage; or
• The wife was already pregnant by another man at the time of marriage.

Our usual practice is to send a formal letter to your spouse to propose divorce terms under a Joint Petition first.

If Joint Petition is not successful, we can proceed with a Unilateral Divorce.

Under Malaysian law, both parties will be required to attend marriage counselling at JPN before the case can proceed in Court.

Usually, there are 3 counselling sessions for each party.

It depends on the JPN office but normally it takes about 4–6 months.

Uncontested Unilateral Divorce
This means the other party does not challenge the divorce.
The minimum period is usually about 6 months.

Contested Unilateral Divorce
This means the other party challenges the divorce (for example, disputes custody, maintenance or refuses the divorce).
The case may take at least 6 months or longer depending on the complexity of the issues and the number of court hearings required.

In short, unilateral divorce normally takes longer than joint petition because it involves counselling and possibly court trial.
