What is the difference between Joint Petition and Unilateral Divorce (Single Petition)?
Joint Petition means both husband and wife agree to divorce and agree on all terms (children, maintenance, property, etc.).
Unilateral Divorce (Single Petition) means only one party wants the divorce. The other party does not agree or does not respond.
How many years must I wait before filing for divorce in Malaysia?
Generally, the minimum period of marriage is 2 years before you can file for divorce.
Can I file for divorce if my marriage is less than 2 years?
Yes but only under Annulment.
Annulment may be allowed if:
• The marriage was never consummated because one party could not or refused to do so;
• One party did not properly agree to the marriage (forced, mistaken, mentally unsound, etc.);
• One party had a serious mental disorder at the time of marriage;
• One party had a communicable sexually transmitted disease at the time of marriage; or
• The wife was already pregnant by another man at the time of marriage.
I want to divorce but I am not sure whether my spouse agrees. What should I do?

Our usual practice is to send a formal letter to your spouse to propose divorce terms under a Joint Petition first.
What if I want a divorce but my spouse refuses?
If Joint Petition is not successful, we can proceed with a Unilateral Divorce.
Under Malaysian law, both parties will be required to attend marriage counselling at JPN before the case can proceed in Court.
Is my spouse required to attend JPN marriage counselling? How many sessions?
Yes. Both parties are required to attend.
Usually, there are 3 counselling sessions for each party.
How long does JPN marriage counselling take?
It depends on the JPN office but normally it takes about 4–6 months.
What documents are required for a Joint Petition?
• Marriage Certificate
• Children’s Birth Certificates (if any)
• Details of joint property/assets (if any)
What is the procedure for a Joint Petition?
Both parties agree on all divorce terms.
We will draft the divorce documents within 3 working days.
Draft will be sent to both parties for approval.
Once approved, we arrange for signing.
After signing, we file the documents in Court.
We will inform both parties once the Court fixes the hearing date.
How many times do we need to attend Court for Joint Petition?
Only one time.
How long does a Joint Petition procedure take?
Usually 1–3 months, depending on court availability.
How much does divorce cost in Malaysia?
The cost depends on whether it is a Joint Petition or a Unilateral Divorce and whether there are disputes involving children, maintenance or property.
• Joint Petition is more affordable because both parties agree.
• Unilateral Divorce may cost more due to counselling requirements and possible court hearings.
How long does unilateral divorce in Malaysia take?
The timeline depends on whether the case is uncontested or contested.
Uncontested Unilateral Divorce
This means the other party does not challenge the divorce.
The minimum period is usually about 6 months.
Contested Unilateral Divorce
This means the other party challenges the divorce (for example, disputes custody, maintenance or refuses the divorce).
The case may take at least 6 months or longer depending on the complexity of the issues and the number of court hearings required.
In short, unilateral divorce normally takes longer than joint petition because it involves counselling and possibly court trial.
